The Office of the Attorney-General of the Federation (AGF) and Minister of Justice, Prince Lateef Fagbemi (SAN), has clarified that no inmate approved for clemency under the latest exercise of President Bola Tinubu’s power of prerogative of mercy has been released from custody.
The clarification comes amid public backlash over the inclusion of certain capital and drug offenders, including Maryam Sanda, who was convicted for the murder of her husband.
In a statement personally signed by the AGF on Thursday evening, Fagbemi explained that the clemency process is still at the final administrative stage, which involves a standard review to ensure that all names and recommendations fully comply with established legal and procedural requirements before any release instruments are issued.
“It is important to note that the last stage of the exercise, after approval by the Council of State, is the issuance of the instrument for the implementation of the decision concerning each beneficiary,” Fagbemi stated.
“This stage affords an opportunity for a final look at the list for remedial purposes, if any, before the instrument is forwarded to the Controller-General of Corrections for necessary action.”
He added that the verification process is part of the government’s commitment to transparency and due diligence, stressing that “there is no delay in the process; it is simply following the law to the letter.”
“As soon as all legal and procedural checks are concluded, the public will be duly informed. The rule of law does not rush; it ensures fairness,” he said.
The AGF also appreciated the public’s vigilance and constructive feedback, saying it reflects Nigerians’ deep concern for justice and good governance.
The Council of State had, two weeks ago, ratified a list of offenders, both deceased and living, presented by President Tinubu as beneficiaries of the presidential prerogative of mercy.
The move, however, triggered widespread criticism following reports that individuals convicted of capital and drug-related offences were among those recommended for pardon.
